Terms & Conditions
Effective date: 15 October 2026·
1. Agreement to these Terms
These Terms and Conditions (the “Terms”) govern your access to and use of the Africa Energies Report website at africaenergiesreport.com (the “Website”) and the Africa Energies Report data platform at app.africaenergiesreport.com, including its dashboards, country profiles, exports, AI reports, alerts and any related content, features and communications (the “App”; together with the Website, the “Services”).
The Services are published by the Africa Energy Investment Corporation (AEICORP), Société Africaine d’Investissement en Énergie, of Lotissement 332, Quartier Zongo Mifongou, 5e Arrondissement de Cotonou, Immeuble Espace Antou, Republic of Benin (“AEICORP”, “we”, “us” or “our”). Africa Energies Report (“AER”) is an initiative of AEICORP and the African Petroleum Producers’ Organization (APPO).
By accessing or using the Services, creating an account or purchasing a plan, you agree to these Terms, our Privacy Policy and our Cookie Policy. If you use the Services on behalf of an organization, you confirm that you are authorised to bind that organization, and “you” includes it. If you do not agree, do not use the Services.
2. Definitions
- “AER Content” means all data, datasets, statistics, dashboards, charts, country profiles, reports, articles, analysis, AI reports, text, graphics, logos and other material made available through the Services.
- “Export” means any file generated from the App, including PNG, PDF, Excel and PowerPoint files.
- “Internal Use” means use within your own organization for research, analysis, decision-making and internal presentations, without making AER Content available to third parties.
- “Publication” means making AER Content available outside your organization, including in published reports, articles, presentations to external audiences, websites, social media, client deliverables and media.
- “Plan” means the access tier that applies to you: Public (no account), Free, Premium or Organization.
- “Authorised User” means an individual permitted by an Organization plan customer to use the Services under its plan.
3. Eligibility and accounts
3.1 Eligibility. You must be at least 12 years old and able to enter into a binding contract to create an account.
3.2 Registration. You must give accurate, current and complete information when registering, including your user category, and keep it up to date.
3.3 Account security. Accounts are personal to one individual. You must keep your login credentials confidential, must not share your account with anyone else, and are responsible for all activity under your account. Tell us immediately at [email protected] if you suspect unauthorised use.
3.4 One account per person. You may not create multiple accounts to exceed plan limits, such as the Free plan’s data window or the Premium plan’s monthly AI report allowance.
4. Plans and access levels
Every Plan gives access to every sector and every country. Plans differ in the depth of data history, features and use rights, as summarised below. The current features, limits and prices of each Plan are set out on our pricing page, which forms part of these Terms. If the pricing page and these Terms conflict, these Terms prevail, except that a signed Organization agreement prevails over both.
Plan | Access | Use rights |
Public (no account) | All sectors and countries, most recent year of data | Personal viewing only |
Free | Three most recent years of data per sector, country overview and energy mix | Personal, non-commercial reference |
Premium | Full data history, PNG and PDF exports, AI reports within a monthly allowance, saved dashboards, sector email alerts, download history | Internal Use |
Organization | Everything in Premium, plus Excel and PowerPoint exports, cross-sector comparison, full country profiles, unlimited AI reports and saved dashboards, priority support | Internal Use and Publication, subject to section 7 |
The data window for each Plan is measured from the most recent year each sector reports, not from the calendar date. We may add, change or withdraw features from time to time in accordance with section 14.
5. Subscriptions, payment and cancellation
5.1 Prices. Prices are shown in United States dollars and exclude any applicable value added tax, sales tax, withholding tax or similar charges, which are added where required by law. Your payment provider or bank may charge currency conversion or transaction fees.
5.2 Payment. Premium subscriptions are paid in advance through PayPal or Flutterwave. By subscribing, you authorise us and our payment provider to charge the chosen payment method for each billing period. Your use of a payment provider is also subject to that provider’s terms.
5.3 Automatic renewal. Premium subscriptions renew automatically at the end of each monthly or annual billing period at the then-current price, unless you cancel before the renewal date. We will remind annual subscribers by email at least 14 days before renewal.
5.4 Cancellation. You can cancel at any time in your account settings or by emailing [email protected]. Cancellation takes effect at the end of the current billing period, and you keep access until then. Your account then reverts to the Free plan.
5.5 Refunds. Payments are non-refundable, including for partially used periods, except: (a) on your first purchase of an annual Premium subscription, you may request a full refund within 14 days of payment if you have not generated any Exports or AI reports; (b) where we terminate your subscription without cause under section 16; and (c) where a refund is required by mandatory consumer protection law in your country. [Confirm refund policy.]
5.6 Price changes. We may change subscription prices. We will give you at least 30 days’ notice by email before a change applies to your next renewal. If you do not agree, you may cancel before the change takes effect.
5.7 Failed payments. If a payment fails, we may retry it, suspend paid features, or move your account to the Free plan until payment is received.
5.8 Chargebacks. If you dispute a valid charge with your bank or payment provider without first contacting us, we may suspend your account while the dispute is resolved.
6. Organization plans
Organization plans are offered under an annual agreement and invoiced directly. The order form, quote or agreement signed by both parties sets out the fee, term, number of Authorised Users and any special terms, and prevails over these Terms where they conflict. The customer is responsible for its Authorised Users’ compliance with these Terms and for promptly removing access for anyone who leaves the organization. Unless otherwise agreed, invoices are payable within 30 days, and Organization agreements renew for successive one-year terms unless either party gives at least 30 days’ written notice before the end of the current term.
7. Licence to use AER Content
7.1 Licence. Subject to these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use AER Content for the use rights of your Plan as set out in section 4. All rights not expressly granted are reserved.
7.2 Internal Use (Premium). Premium subscribers may use AER Content and Exports for Internal Use. Premium does not include Publication rights. Sharing Exports with clients, partners or the public requires an Organization plan.
7.3 Publication (Organization). Organization customers may publish reasonable extracts of AER Content, charts and Exports in their own reports, presentations, articles and client deliverables, provided that:
- each use carries the attribution “Source: Africa Energies Report (AEICORP and APPO), [year]” with a link to africaenergiesreport.com where the medium allows;
- the published material does not reproduce entire datasets, or a substantial part of a dataset, in a way that could substitute for access to the Services;
- AER Content is not presented in a misleading way or altered so that it misrepresents the underlying data; and
- the use does not suggest that AEICORP, APPO or AER endorses the publisher, its views or its products.
7.4 News content. You may share links to articles on the Website and quote short extracts with attribution and a link. Republishing full articles requires our prior written permission.
7.5 Watermarks. Every Export carries a watermark identifying the account it was generated from. You must not remove, obscure, crop out or alter any watermark, attribution, copyright notice or other identifying mark.
8. Acceptable use
You must not, and must not help or allow anyone else to:
- scrape, crawl, harvest or systematically download AER Content by automated means, or use it to build a competing database, product or service;
- use AER Content to train, fine-tune, benchmark or ground any artificial intelligence or machine learning model, except through features we provide, without our prior written consent;
- resell, rent, sublicense, redistribute or commercially exploit AER Content beyond the rights of your Plan;
- share your login, or use technical means to give people who do not hold their own account access to paid features;
- circumvent, disable or interfere with plan limits, the data window, watermarks, access controls or security features;
- reverse engineer, decompile or attempt to derive the source code of the App, except where the law expressly permits this despite this restriction;
- introduce malware, overload the Services, probe for vulnerabilities without our written authorisation, or disrupt other users;
- use the Services in breach of applicable law, sanctions or export controls, or to defame, harass or mislead others; or
- misrepresent your identity, organization or user category, or imply an affiliation with or endorsement by AEICORP, APPO or AER.
If you discover a security vulnerability, please report it responsibly to [email protected] and do not disclose it publicly until we have addressed it.
9. Intellectual property
The Services and AER Content, including their selection, compilation, structure and presentation, are owned by AEICORP or its licensors, including APPO, its member countries and our data partners, and are protected by copyright, database rights, trademark and other laws. The names and logos of Africa Energies Report, AEICORP and APPO are their respective trademarks and may not be used without prior written permission, except for the attribution required by section 7.3. Third-party marks shown in the Services belong to their owners.
10. Data sources and accuracy
10.1 Sources. AER data is compiled from reporting by APPO member countries, national authorities and other sources, validated by our data partners and published as received. Figures may be revised as new or corrected information becomes available, and methodologies, definitions and coverage may differ between countries, sectors and years.
10.2 No guarantee. While we work to ensure that AER Content is accurate and current, we do not warrant that it is complete, error-free or up to date, or that it is suitable for any particular purpose. Figures marked as estimates, provisional or incomplete should be treated accordingly.
10.3 Not advice. AER Content is provided for information only. It is not investment, financial, legal, tax, engineering or other professional advice, and is not an offer, solicitation or recommendation to buy or sell any security, asset or interest, or to enter any transaction. AEICORP is a development finance institution, and nothing in the Services is an offer of financing by AEICORP or the Africa Energy Bank. You should obtain independent professional advice and verify information before making any decision.
10.4 Corrections. If you believe any AER Content is inaccurate, please tell us at [email protected] with supporting detail. We review all reported issues.
11. AI reports
AI reports are generated automatically by artificial intelligence systems using AER data and the parameters you choose. AI output can contain errors, omissions or statements not supported by the underlying data, and may differ each time a report is generated. You are responsible for reviewing AI reports before relying on them. AI reports are subject to the same use rights as other AER Content under your Plan and section 10 applies to them in full. Do not include personal or confidential information in AI report requests.
12. Your submissions and feedback
You keep ownership of anything you submit to us, such as messages and AI report prompts, and grant us a licence to use it to provide and improve the Services. If you send us suggestions or feedback about the Services, we may use them without restriction or obligation to you.
13. Third-party services and links
The Services may link to or integrate third-party websites and services, including payment providers, news sources and social media. We do not control and are not responsible for them, and your use of them is governed by their own terms.
14. Availability, maintenance and changes
We aim to keep the Services available at all times but do not guarantee uninterrupted access. We may suspend the Services for maintenance, security or reasons beyond our control. We may change, add or remove AER Content and features, including datasets, sectors and countries. If we materially reduce the core features of a paid Plan during a billing period, you may cancel and receive a pro rata refund for the unused part of that period.
15. Changes to these Terms
We may update these Terms from time to time. We will give registered users at least 30 days’ notice of material changes by email or through the App, unless a change is required sooner by law or to address security. Continuing to use the Services after a change takes effect means you accept it. If you do not agree, you may cancel your subscription and stop using the Services before the change takes effect.
16. Suspension and termination
16.1 By you. You may stop using the Services and close your account at any time through your account settings or by contacting us.
16.2 By us. We may suspend or terminate your access, with notice where reasonably practicable, if you materially breach these Terms (including sections 7 and 8), if your payment is overdue, if required by law, or if your use creates a security or legal risk for us or other users. In cases of serious breach, such as scraping, account sharing or unlicensed redistribution, we may act immediately and no refund will be due. We may also discontinue the Services or a Plan on at least 60 days’ notice, refunding the unused part of any prepaid fees.
16.3 Effect. On termination, your licence ends and you must stop using AER Content beyond what was lawfully published under your Plan before termination. Sections 7.5 and 8 to 21 survive termination.
17. Disclaimers
To the fullest extent permitted by law, the Services and AER Content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes any warranty or right that cannot be excluded under the law that applies to you.
18. Limitation of liability
18.1 To the fullest extent permitted by law, AEICORP, APPO and their officers, staff, partners and service providers will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, business, investment opportunity, goodwill or data, arising from or in connection with the Services, AER Content or AI reports, even if advised of the possibility of such loss.
18.2 Our total liability to you for all claims arising from or in connection with the Services in any 12-month period is limited to the greater of (a) the fees you paid us for the Services in that period, and (b) USD 100.
18.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law.
19. Indemnity
You agree to indemnify AEICORP and APPO against any claims, losses, damages and reasonable costs, including legal fees, arising from your breach of these Terms, your misuse of AER Content, or your infringement of any third party’s rights.
20. Privileges and immunities
Nothing in these Terms, the Privacy Policy or the Cookie Policy, nor any use of the Services, constitutes or may be interpreted as a waiver, express or implied, of any privilege, immunity or exemption enjoyed by AEICORP or APPO under their constituent instruments, any headquarters or host agreement, international law or the laws of any country, all of which are expressly reserved. [Counsel to confirm wording.]
21. Governing law and dispute resolution
21.1 Governing law. These Terms are governed by the laws of the Republic of Benin, without regard to conflict of laws rules, and subject to section 20.
21.2 Amicable settlement. Before starting any formal proceedings, the parties will try in good faith to settle any dispute by negotiation for at least 30 days after written notice of the dispute is sent to [email protected] or to the user’s account email.
21.3 Arbitration. Any dispute not settled under section 21.2 will be finally resolved by arbitration under the Arbitration Rules of the Common Court of Justice and Arbitration (CCJA) of OHADA, by a sole arbitrator. The seat of arbitration is Cotonou, Republic of Benin, and the language is English. Either party may seek urgent interim relief from a competent authority to protect its intellectual property or confidential information.
21.4 Consumers. If you are a consumer, this section does not deprive you of any mandatory protection under the law of the country where you live, including any right to bring proceedings in your local courts.
22. General
22.1 Entire agreement. These Terms, together with the Privacy Policy, the Cookie Policy, the pricing page and any signed Organization agreement, form the entire agreement between you and us about the Services.
22.2 Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to an affiliate or successor body responsible for AER, provided your rights are not reduced.
22.3 Severability. If any provision is found invalid or unenforceable, the rest of these Terms remain in effect.
22.4 No waiver. A delay or failure to enforce any provision is not a waiver of it.
22.5 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including network failures, power outages, civil unrest, natural disasters or acts of government.
22.6 Language. These Terms may be published in English and French. If the versions conflict, the English version prevails, to the extent permitted by law.
22.7 Notices. We may send notices to the email address linked to your account or by posting them in the Services. You may send notices to us at [email protected] or by post to the address in section 1.
